Terms of Use

These Terms of Use ("Terms") govern your use of Timestamp — Photo Date Stamp (the "App"), published by Elma Digital Ltd ("Elma Digital," "we," "us," or "our"), and this website. By downloading, installing, or using the App, you agree to these Terms.

License to Use the App

Subject to your compliance with these Terms, Elma Digital grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, for your personal, non-commercial use. This license is also subject to Apple's standard Licensed Application End User License Agreement, which applies unless we've provided a separate end user license agreement.

Subscriptions and Payments

Timestamp offers optional auto-renewable subscriptions, purchased and billed through your Apple ID:

• Weekly: $4.99/week, with a 3-day free trial for new subscribers. Unless canceled before the trial ends, it converts automatically into a paid weekly subscription.
• Yearly: $39.99/year.

Prices are shown in USD and may vary by region. Subscriptions automatically renew for the same term unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription anytime in iOS Settings → [your name] → Subscriptions. No refund will be issued for the unused portion of a current subscription period, except as required by Apple's or applicable law's refund policies.

Free Tier

Without an active subscription, the App allows a limited number of stamped photos per session and access to a subset of themes, with additional stamped photos available after watching an optional rewarded ad. These limits and the set of free themes may change from time to time.

Your Photos

You retain all rights to the photos you use with the App. You're solely responsible for making sure you have the necessary rights to any photo you stamp, edit, or save. Elma Digital does not claim any ownership over your photos and does not receive copies of them, as described in our Privacy Policy.

Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the App, except where applicable law permits it;
• Use the App for any unlawful purpose or to process content you don't have the rights to;
• Interfere with or disrupt the App, its servers, or the networks used to make it available;
• Circumvent or attempt to circumvent the App's subscription or free-tier limits.

Advertising

Free-tier use of the App includes ads served by Google AdMob. Ad content is selected and controlled by Google and its advertising partners, not by Elma Digital, and we're not responsible for the content of third-party ads. Premium subscribers do not see ads.

Third-Party Services

The App relies on services from Apple Inc. (App Store distribution and payments), RevenueCat, Inc. (subscription management), and Google LLC (AdMob advertising). Your use of the App is also subject to each of these providers' own applicable terms.

Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the App will be uninterrupted, error-free, or that stamped output will meet every possible use case (for example, as evidentiary proof in a legal or regulatory context).

Limitation of Liability

To the fullest extent permitted by applicable law, Elma Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App, even if advised of the possibility of such damages.

Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete it at any time; deleting the App does not automatically cancel an active subscription, which must be canceled separately through your Apple ID settings.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted here, with the "Last updated" date revised accordingly. Continuing to use the App after changes take effect means you accept the revised Terms.

Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which Elma Digital Ltd is established, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your own country of residence provide otherwise.
